Privacy Statement Pursuant to Art. 13
of Italian Legislative Decree no. 196/2003

In compliance with the privacy regulation in force (Legislative Decree no. 196 of June, 30 2003 “Code on the protection of personal data”), we inform you that Fides S.p.A., running third party credit management and collection activities, retains some of your personal data, whose processing is needed to carry out our customers’ mandates.

The above-mentioned data have been provided by your creditor (our customer) by virtue of the consent to the use of personal data expressly agreed upon when signing the contract which the credit originated from; or they may have been provided at a later stage, by the creditor, by a third party or consulting public registers, lists, deeds or documents accessible to anyone.

The above-mentioned data will be processed and stored by our Company using tools (IT and/or computerized) that guarantee security, confidentiality and full protection of your rights.

Your personal data may be communicated to some of our employees and/or collaborators, who have been purposefully authorized to process them, acting as “people in charge” of the data processing. Moreover, data may be communicated to other collaborators, in charge of carrying out technical, organizational and operational tasks, in order to pursue the above-mentioned purposes. In no case, your personal will be subject to dissemination.

After completing the task, your data will be stored only to allow our company to properly comply with the legal obligations and to report, if necessary, on the activity performed. In any case, unless data management is needed for new collection purposes, once the assignment is over, data will be taken away from the people in charge, who will not be allowed to further consultation.

The data controller is usually the creditor, on behalf of which our Company acts as data processor in order to pursue the above-mentioned purposes. However, considering the peculiar nature of the third party credit management and collection activities, our Company may receive additional data about you, that are essential to fully report the creditor on the activity performed, particularly if the credit is not fully collected. Such data include: solvency risk, financial situation, correct fulfillment of obligations, illicit or fraudulent behaviours, pursuant to article 37, paragraph 1, letter T) of the Legislative Decree 196/2003. Our Company will process the data, acting as data controller, having sent preliminary notice to the Protection Authority for the protection of personal data on 30.04.2004. Furthermore, our company may act as data controller, with reference to credit management and collection activities, if provided for by an agreement or specific law regulations; or necessary for the full performance of the assignment; or inherent to the nature of the relationship and the activities performed.

With respect to the above-mentioned data, you may exercise the rights referred to in Article 7 of Italian Legislative Decree no. 196 of June 2003, which content is reported in the followings:

«Art. 7. Right to access to personal data and other rights
1. The person concerned has the right to obtain confirmation of the existence of personal data and information regarding him/her – even not recorded yet – and their disclosure under an intelligible form.
2. The person concerned is entitled to be informed of:
a) the origin of personal data and information;
b) data treatment purposes and ways;
c) the logic followed in the event of data treatment being carried out with electronic tools;
d) the details to identify the owner, the persons in charge and the representative appointed under article 5, paragraph 2;
e) the people or groups of people to whom personal data and information can be disclosed or who may come to know them in their capacity as representative appointed in the State territory or persons in charge.
3. The person concerned has the right to obtain:
a) updating, correction or – where interested in this process – supplementation of data;
b) cancellation, turning into anonymous data or the block of data treated by infringing the law, including data and information which need not be kept in relation to the purposes for which data and information were collected or subsequently treated;
c) a certificate stating that the operations under sub-paragraphs a) and b) - including their content – have been communicated to those to whom data and information were provided or disclosed, except the case when this proves to be impossible or entails the use of such an amount of means which is overtly non commensurate with the right which is protected.
4. The person concerned has to right to wholly or partially refuse:
a) treatment of personal data and information regarding him/her for legitimate reasons, even though they are relevant to the aim of collection;
b) treatment of personal data regarding him/her for the purposes of sending advertising material, direct sale or performance of market studies or commercial communications.»
